Not that long ago, Republican presidents were carrying out the Clean Air and Water Acts, creating the Environmental Protection Agency, expanding the National Park System and even initiating the country’s most authoritative report on climate change, the National Climate Assessment. Many of today’s Republican leaders stoke fear and anger by mocking the most divisive climate activists while claiming that every environmental solution is a radical one. If they’re not doing that, Republicans can often be found on the sidelines and disengaged from the issue completely. Instead of continuing the environmental legacy they were once known for, they have ceded the fight against climate change to Democrats, putting themselves on the wrong side of history. In other words, Donald Trump’s denial of climate change probably cost him the White House.

This is more or less what Justice Elena Kagan seemed to be wondering during the oral arguments in Donald Trump’s Jan. 6 immunity case at the Supreme Court on Thursday morning. “Wasn’t the whole point that the president was not a monarch and the president was not supposed to be above the law?” she asked. Like her, I had assumed those questions were answered decisively in the affirmative more than 200 years ago. But now, after almost three hours of circuitous debate and bizarre hypotheticals at the Supreme Court, I’m not so sure. And they tried to draw a distinction between official acts, for which a president might have immunity from prosecution, and private acts, for which no immunity would apply.

Donald Trump’s claim that he has absolute immunity for criminal acts taken in office as president is an insult to reason, an assault on common sense and a perversion of the fundamental maxim of American democracy: that no man is above the law. More astonishing than the former president’s claim to immunity, however, is the fact that the Supreme Court took the case in the first place. It is a process so vital, and so precious, that its first occurrence — with the defeat of John Adams and the Federalists at the hands of Thomas Jefferson’s Republicans in the 1800 presidential election — marks a second sort of American Revolution. And if the trial occurs after an election in which Trump wins a second term and he is convicted, then the court will have teed the nation up for an acute constitutional crisis. A president, for the first time in the nation’s history, might try to pardon himself for his own criminal behavior.

Yet, it’s unlikely she will emerge from this battle victorious — a reality that has underscored the importance of Murdoch’s right-wing media empire. While the winds might not entirely favor Greene and the MAGA Media hardliners in this very moment, they do appear to be shifting. The Supreme Court’s conservative majority appeared ready today to rule that former presidents should have some degree of immunity from criminal prosecution. Such a decision, while effectively rejecting Donald Trump’s assertion of absolute immunity, could narrow the scope of the federal criminal case accusing Trump of plotting to subvert the 2020 election. They agreed with the liberal justices mainly about the significance of their decision, which is expected in late June or early July: “We’re writing a rule for the ages,” Justice Neil Gorsuch said. Many of the justices seemed to be considering the idea that presidents should enjoy some form of protection against criminal prosecution. But the liberal justices voiced concern that by offering presidents a shield from prosecution, the court could turn the Oval Office into a “seat of criminality,” as Justice Ketanji Brown Jackson described it.

Seven of the 10 came after Trump was put on notice of the gag order hearing and were rolled into it. As the Court found in issuing the gag order, Trump’s history of attacking his perceived foes presents a serious threat to the safety of witnesses and jurors (among others) and thus to the integrity of the trial. Moreover, the comments at issue concern the trial and are not in regard to Trump’s presidential campaign – at all. The judge may split the baby and order sanctions for some but not all of Trump’s statements.

On Thursday, the U.S. Supreme Court will hear Donald Trump’s arguments that he is immune from prosecution for his efforts to steal the 2020 presidential election. Special counsel Jack Smith’s election-related indictment of Mr. Trump relies on many of the same firsthand witnesses. Although the special counsel reached a number of the same conclusions as the select committee, the indictment is predicated on a separate and independent investigation. The indictment and public reporting suggest that the special counsel was able to obtain key evidence our committee did not have. Public reporting also suggests that members of Mr. Trump’s Office of White House Counsel and other White House aides testified in full, without any limitations based on executive privilege, as did Vice President Mike Pence and his counsel.

The man who lit himself on fire outside of the Manhattan courthouse where Donald Trump’s trial was taking place died Friday night, a senior law enforcement official told CNN. NYPD Chief of Department Jeffrey B. Maddrey said earlier that the man walked into the center of Collect Pond Park, which is directly across from the courthouse. He opened his backpack and took out pamphlets that he scattered in the park before setting himself on fire. The man was taken to Cornell Burn Center earlier in critical condition. Police had said they thought it was not likely that he would survive.
